Washington, DC - JunkScience.com announced that an emergency motion for a temporary restraining order has been filed against the U.S. Environmental Protection Agency (EPA) concerning the agency's illegal human experiments.
Filed by the American Tradition Institute (ATI) in the U.S. District Court for the Eastern District of Virginia, the request asks the Court to order the EPA to immediately : (1) cease all human experimentation in which humans are intentionally exposed to high concentrations of airborne fine particulate matter (PM2.5 or coal soot); and (2) cease using the University of North Carolina Medical Institutional Review Board (IRB).
"Not only has EPA conducted illegal human experimentation with the acquiescence of the University of North Carolina, but its has repeatedly lied to the human subjects about the risks of the experiments," said JunkScience.com publisher Steve Milloy.
"We are asking the Court to put a stop to the illegal EPA human testing pending the outcome of the litigation over the permanent injunction that was requested by ATI on September 21," Milloy added.
As detailed in the earlier lawsuit, since 2004 and up through the Obama administration, EPA researchers have been exposing human volunteers, many of whom are health impaired to concentrated and high levels of PM2.5 and diesel exhaust, both of which have been determined by EPA to be lethal at any exposure and lethal within as little as hours of inhalation.
"EPA has broken virtually every rule established since World War II for the protection of human study subjects in scientific research. Not only does that include federal regulations and EPA's own rules but EPA also faces civil and criminal liabilities under North Carolina state law for this heinous testing," Milloy concluded.
A hearing on the ATI emergency motion will be held on Oct. 5, 2012 at 10am at the U.S. District Court for the Eastern District of Virginia, Alexandria Division. The case is American Tradition Institute Environmental Law Center v. U.S. Environmental Protection Agency and Lisa P. Jackson, Administrator (Civil Action 1:12-cv-01066-AJT-TCB).
